If I remember correctly, the Nightrider was a biker (a member of Toe cutters gang) who had busted out of police custody, killed a cop, stolen the cops interceptor and started a glory run up the trans-con to escape.
I dont think it was Max's intention to kill the nightrider, just to stop him
I think after the game of chicken and max's pursuit, the nighrider realised that his run was over and that max would have inevitably stopped him and brought him back in. (how? I dont know...)
he had lost his testosterone and possibly drug fuelled confidence and the reality of it was hitting him. it was over.
